APPLICABLE REGULATIONS
Section two of article 22 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, LSSI-CE), establishes the following:Service providers may use data storage and retrieval devices on recipients’ terminal equipment, provided that they have given their consent after being provided with clear and complete information about their use, in particular, the purposes of data processing, in accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data.
When technically possible and effective, the recipient’s consent to accept data processing may be provided by using appropriate parameters of the browser or other applications, provided that the recipient must configure it during its installation or update through an express action for this purpose.
The previous paragraph shall not prevent technical storage or access for the sole purpose of carrying out the transmission of a communication over an electronic communications network or, to the extent strictly necessary, for the provision of a service of the information society expressly requested by the recipient.
As stated in the “Guide on the use of cookies”, published by the Spanish Data Protection Agency (hereinafter, AEPD) in 2013, the LSSI-CE applies to any type of file or device that is downloaded to a user’s terminal equipment for the purpose of storing data that may be updated and retrieved by the entity responsible for its installation. The cookie is one of these widely used devices, so, hereinafter, we will refer to these devices generically as cookies.
The obligations established in article 22.2 of the LSSI-CE do not apply to cookies used for any of the following purposes:
Allowing only communication between the user’s equipment and the network.
Strictly providing a service expressly requested by the user.
TYPES OF COOKIES ACCORDING TO THEIR PURPOSE
A cookie is a file that is downloaded to your computer when accessing certain web pages. Cookies allow a website, among other things, to store and retrieve information about the browsing habits of a user or their computer and, depending on the information they contain and how you use your computer, can be used to recognize the user.As stated in the “Guide on the use of cookies” of the AEPD, according to the purpose for which the data obtained through cookies are processed, we can distinguish between:
Technical Cookies: These are cookies that allow the user to navigate through a website, platform, or application and use the different options or services that exist in it, such as controlling traffic and data communication, identifying the session, accessing restricted access parts, remembering the elements that make up an order, carrying out the process of purchasing an order, requesting registration or participation in an event, using security elements during navigation, storing content for the broadcasting of videos or sound, or sharing content via social networks.
Personalization Cookies: These are cookies that allow the user to access the service with some predefined general characteristics based on a series of criteria on the user’s terminal, such as language, the type of browser through which they access the service, the regional configuration from which they access the service, etc.
Analysis Cookies: These are cookies that allow the party responsible for them to track and analyze the behavior of users of the websites to which they are linked. The information collected through this type of cookies is used to measure the activity of the websites, application, or platform and to create navigation profiles of the users of these sites, applications, and platforms, in order to introduce improvements based on the analysis of the usage data made by the users of the service.
Advertising Cookies: These are cookies that allow the management, in the most efficient way possible, of the advertising spaces that, where appropriate, the editor has included on a website, application, or platform from which the requested service is provided based on criteria such as the edited content or the frequency with which ads are displayed.
Behavioral Advertising Cookies: These are cookies that allow the management, in the most efficient way possible, of the advertising spaces that, where appropriate, the editor has included on a website, application, or platform from which the requested service is provided. These cookies store information on the user’s behavior obtained through continuous observation of their browsing habits, which allows the development of a specific profile to display advertising based on it.
